Bygdøy Boligspareklubb won in the Supreme Court

On Friday the judgment was entered that lays down that dwellings in a housing association for senior citizens in Bygdøy shall still be sold to the members of the housing savings club at a price far below market level.

The price shall be based on an indexing of the original cost in accordance with the articles of association of the club and the housing association. The Supreme Court has resolved a case in which the heirs to one of the flats were demanding to be paid almost market rates for the flat when the testator died.

Pål Grønnæss, a partner in Schjødt, represented the Bygdøy housing savings club for senior citizens and is happy that the country's highest court has confirmed that it is still possible to agree mechanisms for sale of dwellings that are not based on market trends.
